Ward Churchill, Faux Indian Leftist Educator, Loses in CO Supreme Court

Ward Churchill, Leftist Educator, a plagiarist like Joe Biden, a Faux Indian, long before Elizabeth Warren discovered she was 1/32 Cherokee, has lost his bid before the Colorado Supreme Court to get his old job back, after he compared 9/11 victims to Adolph Eichmann.


Ward Churchill, lost his appeal to get his job back after he compared Sept. 11 victims with a Nazi, will appeal to the U.S. Supreme Court after the Colorado Supreme Court ruled against him.

His termination in 2007 came after an essay he wrote describing some victims of the Sept. 11, 2001, terrorist attacks as "little Eichmanns," a reference to Adolf Eichmann, the Nazi leader who helped orchestrate the Holocaust.

In its ruling, the Colorado Supreme Court said Churchill had five opportunities to present his own witnesses, cross-examine opposing witnesses and argue his case before the board following allegations Churchill plagiarized some of his academic writings, fabricated evidence and violated the university's academic standards.

"Although we are mindful that a full-fledged, years-long investigation into a professor's academic record taken in bad faith could chill the continued exercise of free speech, we conclude that the federal case law in this area is too unsettled to defeat the regents' claim of qualified immunity," the state Supreme Court judges ruled.

A civil jury in 2009 found the school unlawfully fired Churchill but awarded him only $1 in damages. However, a Denver District judge set aside the verdict and said university regents, who are elected, are a "quasi-judicial" panel with immunity from the lawsuit.

Couldn't happen to a nicer phony.

Left Wing "Nation" Calls for "Borking" Kagen

I've told you before that liberals have a problem understanding "irony".

The Nation, in an article Judging Elena Kagan,

In what is by now an oft-quoted snippet from one of her law review articles, Supreme Court nominee Elena Kagan castigated the confirmation hearings of Justices Souter, Kennedy, Ginsburg and Breyer as a "vapid and hollow charade."

...What is less remarked upon is that in her article Kagan proposed a model for a more vigorous and candid confirmation hearing—that of Judge Robert Bork. The process worked in that instance, she argued, not because of the particular result but because the hearings "presented to the public a serious discussion of the meaning of the Constitution, the role of the Court, and the views of the nominee; that discussion at once educated the public and allowed it to determine whether the nominee would move the Court in the proper direction." In both popular and right-wing parlance, "borking" now means to vilify and defame a nominee in order to block his appointment, but Kagan's description is in fact a far more accurate account of what happened—senators rigorously probed and considered Bork's legal opinions and voted accordingly. So it is with this understanding that we propose, in the spirit of democratic deliberation of which she so eloquently wrote, that Elena Kagan should be borked.

And liberals say that conservatives eat their own! Heh.

White House Micromanages Supreme Court Nominee

The White House trusts her to interpret the Constitution, but not to dress herself?

Interesting story out of New Haven, CT. regarding newly minted Supreme Court Justice Sonia Sotomayor.

NEW HAVEN — Supreme Court Justice Sonia Sotomayor said Saturday her grueling nomination process was a tightly-scripted event, right down to the dress picked out for her.

Is that sexist? Does the White House pick out outfits for the men being confirmed to appointed offices?

Sotomayor even explained that she’d gone shopping for clothes to wear to her acceptance ceremony, but government officials instead told her to bring five suits, one of which they would recommend for her to wear,

Remember the brouhaha over Sarah Palin's wardrobe? Al Gore's "Alpha Male" flannel shirts? Dressing for success is a part of modern electioneering, but Supreme Court nominees??? How image conscious is the White House to need to micromanage the wardrobe of a person whose working garb will consist primarily of a black robe?

People who listened to her speech said she revealed many details of the nomination process to the nation’s highest court

Which the country, I'm sure, would be fascinated to hear! But,

... "She requested that no members of the media attend the conversation"

Pity.

"Ham Sandwich" Approved by Senate for Supreme Court

It has been jokingly noted that a prosecutor could persuade a grand jury to "indict a ham sandwich." I doubt that Barack Obama was thinking of that today when he let his rhetoric outrun his logic:

"With this historic vote, the Senate has affirmed that Justice Sotomayor has the intellect, the temperament, the history, the integrity and the independence of mind to ably serve on our nation's highest court."

Thus spake Barack Obama, aptly demonstrating that he does not have the intellect or temperament to serve on the High Court! In a highly partisan vote, a Democrat president could have nominated a "ham sandwich" as it were, and the majority of Democrats in the Senate would have confirmed it. This is by no means a measure of intellect or temperament, but a crass political sow's ear that Obama would rhetorically remake into a silk purse.

Whether or not Sotomayor has the intellect to ably serve on the Supreme Court is yet to be seen. If she becomes the justice she displayed in her hearings, perhaps. If she reverts to type to the kind of justice she has been in the past, then sadly, she will be found wanting. Time will tell.
